| Abstract: | تعد المحر را ت الرسمية أساسا للثقة في المعاملات القانونية والادارية، ويمثل الاعتداء عليها بجريمة التزوير تهديدا جوهريا للنظام القانوني والاجتماعي، تستهدف هذه الد را سة تحليلا معمقا لجريمة التزوير في المحررات الرسمية ضمن النظام التشريعي الجزا ئري، مع التركيز على القانون الجديد 24 / 02 وما جاء به من مستجدات تحمي المحررا ت الرسمية من التزوير ، من خلال تحديد الإطار النظري بتبيان المفاهيم القانونية لجريمة التزوير في المحررا ت الرسمية، وإبرا ز أركانها وعناصرها وصورها، كما تمت د را سة الإجرا ءات القانونية المتبعة في مرحلة الاستدلال والتحقيق والمحاكمة ، مع إبرا ز أهم التدابير الاحترا زية والعقوبات ومدى تحقيقها لأغرا ض العقوبة لاسيما الردع العام والخاص ، بالاعتماد على المنهج الوصفي لضبط المفاهيم المرتبطة بالموضوع، والمنهج التحليلي لتحليل النصوص القانونية المتعلقة بجريمة التزوير في المحرا رات الرسمية. |
| Description: | Official documents are a fundamental pillar of trust in legal and administrative transactions. The offense of forgery targeting these documents poses a serious threat to the legal and social order. This study aims to provide an in-depth analysis of the crime of forgery in official documents within the Algerian legislative system, with a particular focus on the recent Law No. 24/02 and the new provisions it introduces to safeguard official documents against forgery.The research outlines the theoretical framework by clarifying the legal concepts related to the crime, identifying its elements, components, and various forms. It also examines the legal procedures followed during the stages of investigation, inquiry, and trial, while highlighting the key precautionary measures and penalties applied, and evaluating their effectiveness in achieving the purposes of punishment, particularly general and specific deterrence.The study adopts a descriptive approach to define the relevant concepts and an analytical approach to interpret the legal texts related to the crime of forgery in official documents. |
