| Abstract: | تناولت هذه المذكرة موضوع عقوبة العمل للنفع العا م كبديل للعقوبا ت السالبة للحرية في القانون الجزا ئري، في ضوء التوجها ت الحديثة نحو اعتما د بدائل للعقوبا ت التقليدية، بما ينسجم مع مبادئ العدالة التصالحية ويُسهم في الحد من الاكتظاظ داخل المؤسسا ت العقابية .تم التطرق إلى الأساس القانوني لهذه العقوبة، وشروط تطبيقها، والجها ت المختصة بتنفيذها، إضافة إلى آثارها القانونية والاجتماعية .وخلصت الد را سة إلى أن هذه العقوبة تُعد أدا ة فعّالة لإعادة إدماج المحكوم عليه في المجتمع، غير أنها لا تزال بحاجة إلى دعم تشريعي وتطبيقي أوسع لضمان فعاليتها |
| Description: | This thesis examines community service punishment as an alternative to custodial sentences in Algerian legislation, aligned with modern approaches that promote alternatives to traditional punishments, in accordance with restorative justice principles and efforts to reduce overcrowding in penal institutions. The study analyzes the legal basis, conditions of application, executing authorities, and legal and social impacts of this sanction. The findings highlight that this measure is an effective means for reintegrating offenders into society, although it still requires broader legal and practical support for effective implementation |
