| Abstract: | تعد الوساطة الجنائية في قضاء الاحداث من الآليات الاجرا ئية الحديثة التي أقرها المشرع الجز ا ئري في إطار قانون حماية الطفل، وتهدف إلى التخفيف من الضغوط التي يواجهها نظام العدالة الجنائية خاصة فيما يتعلق بالقضايا التي يكون طرفها الجانح طفلا، وتفتح من خلال هذه الآلية فرص الحوار والتفاوض بين الحدث والضحية، بغرض التوصل إلى تسوية ودية للنزا ع الجنائي، ضمن نطاق يشمل جميع الجنح والمخالفات، وتحت إشرا ف ورقابة وكيل الجمهورية باعتباره الضامن لحماية المصلحة العامة. وتمثل هذه الوساطة نموذجا جديدا لعدالة جنائية تربوية تقوم على مبدأ الرضائية والملاءمة وتساهم في إعادة إدماج الحدث في المجتمع بعيدا عن اثار للإجرا ءات القضائية التقليدية. |
| Description: | Criminal mediation in juvenile justice is one of the modern procedural mechanisms approved by the Algerian legislator within the framework of the Child Protection Law, which aims to alleviate the pressures faced by the criminal justice system, especially with regard to cases involving child offenders. Through this mechanism, opportunities for dialogue and negotiation are opened between the juvenile and the victim, with the aim of reaching an amicable settlement of the criminal dispute, within a scope that includes all misdemeanors and offenses, under the supervision and control of the public prosecutor as the guarantor of the protection of the public interest. This mediation represents a new model of educational criminal justice based on the principle of consent and appropriateness and contributes to the reintegration of juveniles into society without the effects of traditional judicial procedures. |
