| Abstract: | تعتبر المسؤولية الج ا زئية لمشخص المعنوي من أهم الد ا رسات القانونية الأكثر تسارعا وتعقيدا في الوقت الحاضر، حيث كرس المشرع الج ا زئري هذه المسؤولية بعد تردد كبير و أوحاطها بإج ا رءات وعقوبات تتماشى مع طبيعة الشخص المعنوي، خاصة بعد آخر تعديل لممادة 15 مك رر من قانون العقوبات لسنة 0202 ، أن المشرع الج ا زئري قصر المسؤولية الج ا زئية للأشخاص المعنوية الخاضعة لمقانون الخاص فقط مع استثناء الأشخاص المعنوية الخاضعة لمقانون العام. كما تطبق عمى الشخص المعنوي الإج ا رءات المنصوص عميها في قانون الإج ا رءات الج ا زئية، المتعمقة بالمتابعة و التحقيق و المحاكمة المعروفة التي تطبق عمى الأشخاص الطبيعيين واج ا رءات تحريك ومباشرة الدعوى العمومية وكيفية الاتصال بالدعوى العمومية |
| Description: | The criminal liability of legal entities is considered one of the most rapidly evolving and complex areas of legal studies at present. The Algerian legislator has dedicated this responsibility after much hesitation and urrounded it with procedures and penalties that align with the nature of legal entities, especially following the latest amendment to Article 51 bis of the Penal Code in 2024. The Algerian legislator has limited criminal liability to legal entities subject to private law,excluding those subject to public law. The procedures outlined in the Code of Criminal Procedure regarding prosecution, investigation, and the trial that apply to natural persons also apply to legal entities, in addition to the procedures for initiating and prosecuting public actions and how to interact with public actions. |
