| Abstract: | تعد السياسة الجزائية الحديثة محورا بالغ الأهمية في الإصلاحات القانونية المعاصرة، نظرا لسعيها لموازنة متطلبات الكفاءة الإجرائية مع ضمانات المحاكمة العادلة. تبحث هذه الدراسة في إشكالية مدى تحقيق هذا التوازن في التشريع الجزائري، من خلال تحليل آليات السياسة الجزائية الحديثة وانعكاساتها على منظومة العدالة. وعليه قسمت الدراسة إلى فصلين: الفصل الأول يستعرض متطلبات السرعة الإجرائية في ظل السياسة الجزائية الحديثة، بينما ركز الثاني على مناقشة ضمانات المحاكمة العادلة في ظل الإصلاحات التشريعية الحديثة. وخلصنا إلى أن تعزيز السرعة الإجرائية لا يتناقض جوهريا مع مبادئ العدالة، بشرط وضع ضوابط تكفل حقوق الأفراد وتحمي الضمانات الدستورية. ولهذا لا بد على المشرع الجزائري سد الثغرات التي قد تهدد التوازن المنشود وذلك عبر توافق أكبر مع المعايير الدولية لحقوق الإنسان. كما تبرز الدراسة في الأخير دور السياسة الجزائية الحديثة في تجاوز تعقيدات العدالة التقليدية، مع التأكيد على ضرورة تكريس آليات رقابية لضمان عدالة الإجراءات دون إهدار للحقوق الأساسية. |
| Description: | Modern Criminal Policy Stands As A Pivotal Axis In Contomporary Legal Reforms, as it seeks to balance the demands of procedural efficiency with the guarantees of a fair trial. This study examines the extent to which this balance is achieved within algerian legislation by analyzing the mechanisms of modem criminal policy and their implications for the justice system. The research is divided into two chapters : the first explores the requirements of procedural speed under modern criminal policy, while the second focuses on discussing the safeguards of fair trial guarantees within the framework of recent legislative reforms. The study concludes that enhancing procedural efficiency does not inherently contradict the principles of justice, provided that controls are established to safeguard individual rights and constitutional guarantees. Consequently, algerian legislators must address gaps that may threaten the desired balance by aligning more closely with international human rights standards. Additionally, the study highlights the role of modem criminal policy in overcoming systemic complexities with in justice systems, emphasizing the necessity of institutionalizing oversight mechanisms to ensure procedural fairness without compromising fundamental rights. |
