| Abstract: | كرّس المشرّع الجزا ئري منظومة تشريعية متكاملة لمكافحة آفة المخد را ت، إد را كًا منه لخطورتها المتزا يدة على أمن واستقرا ر المجتمع . وقد شكّل القانون رقم 04-18 المؤرخ في 21 ديسمبر 2004 ، المعدل والمتمم، الإطار القانوني الأساسي في هذا المجال، حيث تضمّن تجريم كافة أشكال الاستعمال والاتجار غير المشر وع بالمخد را ت والمؤثرا ت العقلية، مع إقر ا ر عقوبات مشددة، لا سيما إذا تعلّق الأمر بجريمة منظمة أو عابرة للحدود .تتجلّى الآليات التشريعية المعتمدة في هذا السياق من خلال محورين رئيسيين؛ الأول ردعي زجري يتمثل في تشديد العقوبات وتوسيع نطاق التجريم، والثاني إجرا ئي وقائي، عبر تمكين الجهات المختصة، وخاصة الضبطية القضائية، من الخروج من القواعد العامة لبعض الإجراءات وكذا استعمال أساليب التحري الخاصة لمنصوص عليها في قانون الإجرا ءات الجزا ئية، كوسيلة فعالة للكشف عن الشبكات الإجرا مية وتفكيكها، ويُظهر هذا التوجه توازنًا بين حماية المجتمع من أخطار المخد ا ت وضمان احترا م الحقوق الدستورية للمشتبه فيهم أثناء سير الدعوى العمومية |
| Description: | The Algerian legislator has established a comprehensive legal framework to combat the scourge of drug-related offenses, recognizing their increasing threat to the security and stability of society. Law No. 04-18 of December 21, 2004, as amended and supplemented, constitutes the principal legal instrument in this regard. It criminalizes all forms of illicit trafficking in narcotic drugs and psychotropic substances, imposing severe penalties, especially in cases involving organized or transnational criminal activity. The legislative mechanisms adopted in this context are manifested through two main pillars: a repressive-deterrent axis that strengthens penalties and expands the scope of criminalization, and a procedural-preventive axis that empowers competent authorities particularly the judicial police to employ special investigative techniques provided under the Code of Criminal Procedure. These include surveillance, infiltration, and the interception of communications, representing effective tools for detecting and dismantling criminal networks. This approach reflects a balance between safeguarding society from the dangers of drugs and ensuring respect for constitutional rights during criminal proceedings. |
