| Abstract: | تناولت مذكرتنا موضوع اللجنة الإدارية المتساوية الأعضاء هذه التسمية الجديدة التي أطلقت 03 ، حيث تم إضافة لفظ الإدارية بغرض - على اللجان المتساوية الأعضاء بعد صدور الأمر 06 تميزها عن اللجان المتساوية الأعضاء في الهياكل الأخرى . إن اللجان الإدارية هي هيئة تمثيلية استشارية استحدثت في نظام الوظيفة العمومية الجزا ئري و الهدف منها هو إشراك الموظف في تسيير حياته المهنية ل ضمان العدالة ، تضم تشكيلتها عدد متساو من الأعضاء ممثلي الإدارة و ممثلي الموظفين ، حدد القانون مدة عهدتها ب 3 سنوات قابلة للتجديد مع إمكانية تمديدها أو تقليصها لضرورة المصلحة، يتولى رئ استها السلطة التي لها صلاحية التعين، تعقد اللجنة دورتين خلال السنة، اجتماعاتها و مداولاتها تتميز بالطابع السري، لها العديد من الاختصاصات التي أسندها لها القانون في مجال النظر في أوضاع الموظفين سواء بصفة جماعية أو فردية، كما تعنى أيضا بصفة أساسية بمجالات تأديب الموظف. إن اللجان الإدارية تصدر حسب اختصاصاتها آ را ء استشارية لا يمكن الطعن فيها لأنها لا تكتسب الطابع التنفيذي، و أما الآ را ء الإلزا مية فهي تقبل الطعن فيها بعد صدور القرا ر التأديبي من السلطة التي لها صلاحية التعين في العقوبات من الدرجة الثالثة و الرا بعة، و الطعن في هذه الحالة قد يكون إداريا و أمام لجة الطعن أو قضائيا إمام الجهة القضائية المختصة |
| Description: | Our discussion focused on the topic of the newly created administrative appeals committee, which was established based on the ministerial decision issued on 06- 03.Unlike other structures in the blicadministration ,this Committee is part of the grievance system available to Algerian public official.It purpose is to consider professional appeals to ensure fairness and includes a members from both. the administration and employees. law defines its duration as three renewable years , with the possiblity of expanding or reducing the number of its members depending on the authority that established it. The committee meets periodically throughout the year,and its recommendations,although non – binding carry significant value due to its impartial composition and the sensitivity of its mission, espencially considering the complex or collective situation of employees, whether they are individual or group complaints. Administrative appeals fall under the jurisdiction of this ommittee based on its technical and consultative nature. Appeals against its decisions are not permitted because its opinions are not permitted because its opinions are not binding.However, if opinions are not binding.however , if the final decision is issued by the authority with the power of appointment in the fourth grade,appeals in this case may be either administrative or judicial before the competent litigation committe.
