Abstract

This study reviews the fundamental institutional transformation brought about by the establishment of the Constitutional Court under the 2020 amendment, as a key mechanism for entrenching the rule of law and constitutional review in Algeria. Instead of merely amending the Constitutional Council for greater ndependence and effectiveness, the amendment fundamentally reshaped it by expanding its jurisdiction and strengthening its legal standing as the guarantor of respect for the Constitution.Consequently, the Constitutional Court represents a fundamental structural development in the Algerian constitutional system. It is expected to activate judicial review of the constitutionality of legislation and consolidate constitutional justice. It is tasked with verifying the conformity of legal and regulatory texts and international treaties with the Constitution through the mechanisms of notification and pleas of unconstitutionality, the latter being one of the most prominent innovations of the 2020 Constitution, enabling individuals to contribute to constitutional review and enhance judicial protection of rights and freedoms. The court's review is characterized by a complex legal and political nature due to its composition.
