| Abstract: | شهد التنظيم القضائي الإداري في الجزائر عدة تطورات مهمة، خاصة في ظل التعديل الدستوري لسنة 2020 ، الذي جاء لتعزيز استقلالية القضاء وتحقيق فعالية أكبر في الفصل في المنازعات الإدارية. يشمل هذا التعديل استحداث محاكم إدارية للاستئناف، تكريسًا لمبدأ التقاضي على د رجتين، وإعادة تنظيم هياكل القضاء الإداري لضمان توزيع أكثر دقة للاختصاصات بين الجهات القضائية، حيث يركز هذا البحث على دراسة هذه التحولات، مع تحليل تأثيرها على حماية الحقوق وضمان العدالة، من خلال استعراض هيكلة القضاء الإداري الجديدة وتوزيع الاختصاص بين محاكم الدرجة الأولى وجهات الطعن. |
| Description: | The administrative judicial system in Algeria has undergone significant developments, particularly following the constitutional amendment of 2020, which aimed to strengthen judicial independence and enhance the ffectiveness of administrative dispute resolution, This reform introduced administrative appellate courts, reinforcing the principle of two-tier litigation, and reorganized the structure of administrative courts to ensure a more precise distribution of jurisdiction among judicial bodies, This research focuses on analyzing these reforms, examining their impact on the protection of rights and the assurance of justice, by exploring the new structure of the administrative judiciary and the distribution of jurisdiction between first-instance courts and appellate bodies. |
