| Abstract: | يعد استجواب المتهم من أهم اجرا ءات التحقيق الابتدائي حيث يقوم قاضي التحقيق بمواجته بالتهم المنسوبة إليه وسماع أقواله، خلال هذا الاجرا ء يتمتع المتهم بعدة ضمانات أساسية منها: إعلامه بطبيعة التهمة الموجهة إليه، حقع في الصمت، حقه في إحضار محام، وعدم جواز إكراهه أو التأثير عليه بأي وسيلة غير مشروعة، وتوثق جميع أقواله في محضر رسمي، حيث يتم اتصال قاضي التحقيق بملف الدعوى عن طريق إحالة الملف من النيابة العامة، أو بناءا على شكوى مباشرة من المتضرر، أو ما يخول له مباشرة إجراءات التحقيق وفقا للقانون الجزا ئري |
| Description: | The interrogation of the accused is one of the most important procedures in the preliminary investigation. During this process, the investigating judge confronts the accused with the charges brought against them and listens to their statements. The accused enjoys several fundamental guarantees during this procedure, including: being informed of the nature of the charge, the right to remain silent, the right to have a lawyer present, and protection from coercion or influence by any unlawful means. All statements are documented in an official report. The investigating judge becomes involved in the case file either through a referral from the public prosecutor, based on a direct complaint from the victim, or through powers granted by Algerian law to initiate investigative procedures. |
