Abstract

This study addresses the issue of evidence in cybercrime under Algerian legislation, as one of the ontemporary topics imposed by technological advancement and the emergence of new types of crimes that require different evidentiary mechanisms from traditional ones. The aim of the study is to highlight the effectiveness of the Algerian legal system in confronting the challenges of evidence in cybercrimes, and to assess the adequacy of the adopted technical and legal tools.The study adopts a descriptive and analytical approach by analyzing relevant legal texts and examining judicial and scholarly applications. Data were collected from legislative sources, judicial precedents, and specialized academic studies. The study concludes that the Algerian legislator still needs to develop the legal framework for evidence in cybercrime cases, in a way that ensures a balance between the protection of rights and freedoms and the effectiveness of criminal prosecution.
