| Abstract: | تعالج هذه الد را سة المعنونة ب" العنف الأسري وأثره على جنوح الأحداث في التشریع الجزا ئري"، علاقة العنف الأسري بجنوح الأحداث وذلك من خلال إبرا ز ما مدى مساهمة التشریع الجزا ئري للتصدي لظاهرة العنف الأسري كأحد الأسباب المؤدیة إلى جنوح الأحداث؟ من خلال تحدید الإطار المفاهیمي والنظري لظاهرة العنف الأسري وجنوح الأحداث، والنظریات المفسرة لها، إلى جانب إب ا ز العلاقة بین العنف الأسري وجنوح الأحداث، من خلال الإشارة إلى العوامل المؤثرة في زیادة جنوح الأحداث والإطار 12 المتعلق بحمایة الطفل - القانوني الذي ینظم آلیات حمایة الطفل في الجزا ئر تحدیدا قانون رقم 15 وقانون العقوبات. وفي النهایة خلصت الد را سة إلى نتائج منها أن جنوح الأحداث لا یأتي من فرا غ، بل هو نتیجة ترا كمات، أبرزها وأكثرها تأثیراً العنف الأسري، والخطر الأكبر یكمن في أن الطفل إذا اعتاد العنف، قد یرا ه أمراً طبیعیًا، مما یدفعه إلى تكرا ره مع الآخرین أو تقبّل الإهانة كجزء من حیاته الیومیة وهذا ما یخلق حلقة مفرغة من العنف والألم والجنوح. |
| Description: | This study, titled "Domestic Violence and Its Impact on Juvenile Delinquency in Algerian Legislation," explores the relationship between domestic violence and juvenile delinquency. It highlights the extent to which Algerian legislation contributes to addressing domestic violence as a key factor leading to juvenile delinquency. The study defines the conceptual and theoretical frameworks of domestic violence and juvenile delinquency, along with the explanatory theories. It also emphasizes the connection between the two phenomena by identifying the contributing factors to juvenile delinquency and the legal framework that governs child protection echanisms in Algeria, particularly Law No. 15-12 on child protection and the Penal Code. In conclusion, the study found that juvenile delinquency does not emerge in a vacuum but results from a range of accumulated factors—most notably, domestic violence. The greatest danger lies in the possibility that, if a child becomes accustomed to violence, they may perceive it as normal, leading them to reproduce violent behavior toward others or accept humiliation as a regular part of life. This ultimately creates a vicious cycle of violence, uffering, and delinquency. |
