| Abstract: | تهدف هذه الد را سة الى إبرا ز دور الصفقات العمومية 23 / 12 في تفعيل التنمية المحلية حيث قمنا باستعرا ض الصفقات العمومية والقوانين التي تخضع لها، ثم تقديم مفاهيم عن الإدارة المحلية وكدا التنمية المحلية بالإضافة إلى شرح البرا مج التنموية الخاصة ببلدية ميلة محل الد را سة. من أجل الوصول الى هدف هذا البحث تم إعداد د را سة حالة حول دور الصفقات العمومية 23 / 12 في تفعيل التنمية المحلية، للوقوف على مرا حلها وإجرا ءاتها وصولا إلى مرحلة دفعها وإبرا مها حيث سنقوم في هده الد را سة القاء الضوء على مدى فعالية الصفقات العمومية كأداة لإنجاز المشاريع في التنمية المحلية، ولتحقيق ذلك تم تقسيم الد را سة إلى ثلاثة فصول. وفي الأخير توصلت الد را سة الى مجموعة من النتائج أهمها أن الصفقات العمومية لا تتطلب مبالغ مالية ضخمة فقط لتحقيق أهدافها، وإنما تتطلب الى جانب ذلك إدارة كفؤ وفعالة وجهاز فني مؤهل ومدرب، ومساندة حكومية وشعبية واعية ومخلصة ، كما أنها عملية إجرا ئية قانونية لتبرير صرف المال العام والابتعاد عن المخالفات القانونية وما يترتب عليها من مساءلات تخص سلامة أوجه وطرق الإنفاق ،كما تعتبر أداة تنفيد مخططات التنمية الوطنية والمحلية على حد سواء. |
| Description: | This study aims to highlight the role of public contracts 12/23 in activating local development, as we reviewed public contracts and the laws that are subject to them, then presented concepts about local administration and local development, in addition to explaining the development programs of the municipality of Mila under study. In order to reach the goal of this research, a case study was prepared on the role of public contracts 12/23 in activating local development, to identify its stages and procedures leading to the stage of pushing and concluding it. In this study, we will shed light on the effectiveness of public contracts as a tool for completing projects in local development. To achieve this, the study was divided into three chapters.Finally, the study reached a set of results, the most important of which is that public contracts do not only require huge sums of money to achieve their goals, but in addition to that, they require efficient and effective management, a qualified and trained technical staff, and conscious and sincere governmental and popular support. It is also a legal procedural process to justify spending public money and moving away from it. It is also considered a tool for implementing both national and local development plans. |
