| Abstract: | لقد انعكس التطور التكنولوجي لمختلف المنتجات سلبا على المستهلك من خلال افته على اقتناء المنتجات الخطيرة مع جهله بمخاطرها مما أدى إلى انعدام التكافؤ بين المستهلك والمتدخل في العلاقة التعاقدية، وفي كثير من الأحيان ما يلجأ المستهلك تحت ثير الإعلا ت إلى اقتناء منتجات دون أن يدرك مدى خطورا، وما قد يلحقه من أضرار جسيمة تمس أمنه وسلامة جسده، لذا كان لزاما على المشرع التدخل بوضع آليات تكفل الحماية القانونية له، من بينها فرض الالتزام لتحذير من المنتجات الخطرة من خلال التأكيد على إلزامية إحاطة المستهلك بمخاطر المنتجات وكيفية استخدامها، ورتب حقه في الحصول على التعويض |
| Description: | The technological development of the various products has negatively affected the consumer by rushing to purchase dangerous products with no knowledge of its dangers. This led to a lack of parity between the consumer and the interlocutor in the contractual relationship. The consumer often prefer buying some products under the influence of advertisements without realizing how dangerous they are. In addition to the harm that may cause serious damage to his health and his safety. Consequently, the legislator is obliged to intervene by imposing mechanisms to ensure legal protection for him. Among them, he arranged the right of the consumer to get a compensation and imposing the obligation to warn against hazardous products by emphasizing the obligation to inform the consumer of the products ‘risks. |
