| Abstract: | هدفت هذه الدراسة إلى تسليط الضوء على آليات الرقابة المالية القبلية والبعدية على الصفقات العمومية مع جعل البلدية نموذجا، فالبلديات مقر الولايات التي تم تطبيق الرقابة المالية القبلية والبعدية على صفقاتها تدريجيا ابتداء من سنة 2012 لتشمل كامل بلديات الجمهورية في خلال سنة 2013 ، ومع صدور المرسوم 247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، ظهر جليا الدور المهم للرقابة – الرئاسي 15 المالية على الصفقات العمومية، ولتحقيق ذلك تم تقسيم الدراسة إلى فصلين. وقد خلصت الدراسة إلى أن لآليات الرقابة المالية القبلية والبعدية على الصفقات العمومية للبلدية علاقة متكاملة من خلال دورهما في حماية المال العام، حيث يعتبر التشريع الحالي للصفقات العمومية أداة فعالة لتعزيز عمل هاته الآليات من خلال شفافية الإجراءات المطبقة، وهذا ما تجسده مختلف أجهزة الرقابة القبلية المطبقة على مختلف مراحل إبرام الصفقة محل الدراسة غير أن الرقابة البعدية لم تفعل على الصفقة محل دراستنا كونها منجزة حديثا، وهي تأتي غالبا بعد فترة طويلة من إنجاز الصفقة |
| Description: | This study aimed to address the mechanisms of financial control before and after to public deals, by making the municipality as a model. the municipalities whose transactions were gradually applied to financial control before and after starting from 2021,to include all municipalities of the republic during the year 2013. With the issuance of republican decree N°:15-247 that regulate public deals, the important role of financial control over financial transaction has become evident .to achieve this, the study was divided into two chapters. The study concluded that the mechanisms of financial control , before and after, have a great role in protecting public money .the current legislation for public transactions is considered as an effective tool to enhance the work of these mechanisms through the transparency of the procedures applied ;this is what is embodied by the various pre control devices at the various stages of the application of deals.
